MINUTES OF PLANNING COMMITTEE

2. DECLARATIONS OF INTEREST

Councillors were reminded of their responsibility to continually update their Notice of Registerable Interests and invited to state whether they had a personal or prejudicial interest in any matter to be discussed during this meeting

  • Cllr Ansell declared a personal and prejudicial interest in the planning application at Start View Lodge, Hallsands due to them being a business customer.

2. OPEN FORUM

No members of the public present the Open Forum was dispensed with.

4. MINUTES

The Minutes of the last Planning Committee were noted and approved at full council no further planning committee has been called until this meeting.

The Clerk gave an outline of the documents used as policy including the old Local Plan 1989 – 2001, the adopted and developing Local Development Framework explaining the Core Strategy and Core Policies resulting in Development Policies with all supplementary Development Plan Documents. An explanation of pre application meetings with applicants/developers was then given along with a parish overview of current Section 106 and Community Infrastructure Levy and how these are arrived at. Overall is was explained that Parish Council is not a statutory consultee but invited to give local observations and ultimately District is the Planning Authority who will make a decision on the balance of all information received.

Councillors were cautioned to always consider when commenting that they are mindful of the current Code of Conduct and their responsibilities under such.

It was then noted that the Parish Council give their observations before a Planning Officer puts together a report with a proposed decision. If the decision accords with Parish and the Local Member (District Councillor) agrees then an officer delegated decision is sent out. If the Parish Council do not accord with the proposed response then the District Councillor can either agree with the Planning Officer due to further information or ask for the application to go to District Planning Committee for a decision. All consideration must take into account the policy.

5. PLANNING & PLANNING MATTERS

Applications to be considered at this meeting:

  • 1136/11/F Demolition of existing dwelling (Langholm) and existing Doctor's Surgery and their replacement with 2 residential dwellings and associated works Langholm, Chillington - No objection. The proposed development however was not felt to be contemporary enough to sit adjacent to a Listed Building. The possible visibility of the voltaic panels being situated on the road side is a concern as these will be prominently visible when approaching the entrance to the village as with the solar thermal roof panels and this is not felt to be in keeping with the adjacent Listed Building. The main concern is access to the main nowadays very busy road at this point and it is felt a wider visibility splay could be made to improve warning for cars approaching at the speed limit from Stokenham.
  • 1180/11/F Demolition of existing bungalow and erection of a new 4 bedroom bungalow Ashley Holmleigh Road, Torcross – Objection. This proposals is felt to be not in keeping with other bungalows in the vicinity due to the proposed flat roof which is visible from surrounding areas. Due to the increased size it is felt to be overdevelopment for this plot.

Cllr. Ansell left the meeting whilst this application was discussed.

  • 1257/11/F Householder application for extension and refurbishment to single storey dwelling with general landscaping to garden Start View Lodge, Hallsands – No objection. Parish Council would prefer to see the proposed lap fencing replaced by stone to be in keeping with this locality. It is requested that a condition is imposed to ensure that the road down to Hallsands is surveyed in its current state and any repair works necessary after such delivery vehicles and machinery have accessed is carried out thereafter.
  • 1322/11/F Resubmission of planning approval reference 53/1175/10/F (householder application for reconstruction of existing garages) Higher Lannacombe Mill, Lannacombe – No objection.

Cllr. Mrs Lockwood left the meeting.

6. CORRESPONDENCE AND REPORTS

  • Copy letter of objection to application 1136/11/F dated 4th June 2011.
  • Copy letter of objection to applications 1180/11/F dated 6th June 2011.
  • Councillors were advised of recent emails from District and the Chillington Community Association with regard to Section 106 payments from the Helmers Development and the rear of Penn Cottage. Such monies are part of a legal agreement with District and thus no allocation can be made without their agreement and all monies must be spent in accordance with such agreements in view of the Community Infrastructure Levy regulations in place since April 2010. Advice and guidance is being sought from District legal department.
  • A copy email advising that no planning breach had occurred at Chillington Post Office in relation to a complaint from a member of the public in relation to an 'A' board.
  • An update was given with regard to the completion of piling work at Helmers Field and Taylor Wimpey's intention to put in planning for amendments and additions.
  • Notification has been received that there is a consultation document out for response by 30th June 2011 in relation to making it easier for change of use from business to residential.

Cllr Mrs Steer left the meeting.

7. NEXT PLANNING COMMITTEE MEETING

The next planning committee will be held on the first Monday in July, if necessary. Any applications received in the interim will be considered at full council on 16th June 2011 in the Stokenham Parish Hall, Wesley Smith Room at 7.30p.m.
