1.        DECLARATIONS OF INTEREST

 

Councillors were reminded of their responsibility to continually update their Notice of Registerable Interests and invited to state whether they had a personal or prejudicial interest in any matter to be discussed during this meeting.

 

  • Cllr. Foss declared a personal and prejudicial interest in application 2087/08/F being a near neighbour and housing prospective purchasers of these apartments in his B&B.

 

2.        OPEN FORUM

 

In attendance were Mr Stevens, Mr Smith, Pc Mutton, Sgt Jane Corkhill and Brian George Area Manager for the South West at Devon County Council.

 

The Chair invited the police to address the meeting first aware they may have duties they wished to attend to.  Pc Mutton advised that there had been two crimes committed in the last 3 months compared to last year when 4 were committed during this period.

 

Pc. Mutton then welcomed councillors to put questions or advise him of matters he was unaware of.  Cllr Foss expressed his deep concern that the recent weekend project commissioned by the local police to deal with drugs in local hostelries had reduced any goodwill previously achieved in the community.  He noted that from reports of those he knew who had been present at one such pub that the way in which this project was carried out was not in keeping with the level of such crime in a very rural village.

 

Sgt. Jane Corkhill defended the planning of this project which had been fully endorsed by local pubs etc.  She advised that everyone had been aware and had approved such presence in their establishments.  Cllr. Foss countered that it was not the partnership and agreement to such but more the way in which the whole matter had been conducted.  Local reports although maybe fired by personal indignation did not change the fact that locals were aware that officers had previously been in place in some establishments and that the project as run did not deal with those who were targeted but had inconvenienced and annoyed those using such facilities appropriately.  Such discussion took place and those in attendance left the matter as reported.

 

Sgt. Jane Corkhill left the meeting.

 

The Chair then invited Brian George to explain why such funding for the resurfacing of the A379 from Carehouse Cross to Torcross had been put on hold.

 

Brian George apologised and advised the he personally was sorry that he had not been able to identify such shortfall earlier but had been busy with other more specific rather than overarching budgets.  He explained that many projects are put on high priority at the beginning of the financial year across the county cognisant of the fact that some will fall by the way due to circumstances.  It was only the half yearly review against budget when all Area Managers meet that such discrepancies had been identified.  All projects this year have gone ahead and run to budget and thus those finances earmarked for Stokenham Parish are not available.  He did assure everyone present however that this project now moves to top priority for the 2009/10 financial year.  Consideration had been given to whether some works could be done in February/March and other periods of the year but this section of road is compounded by high tourism use and thus the windows for work are limited.

 

Such works are therefore expected to be carried out December/January 2009/10 and the funds will be safe guarded till that period.  If works can be drawn back in time then Brian George assured all present that he would liaise with parish council and businesses and ensure that such was done.

 

Cty Cllr. Brazil requested that Brian George or a senior Officer give Stokenham Parish Council an assurance that these works will be commenced and also allow the Parish Council the ability to control when such works will commence.  Brian George assured that a letter giving an assurance of that such works will be implemented in this or the next financial year will be sent.

 

Mr Stevens and Richard Smith (joint proprietor of Church House Inn, Stokenham) attended to consider these highway concerns and put forward their concerns and suggestions with regard to implementation of such works.  All these concerns were addressed and noted by Brian George.

 

Brian George then asked council’s views on HGV notices that will be placed at the end of Kiln Lane and the junction to Coleridge Cross.  It was felt that these notices would not necessarily cure the problem but councillors were content for them to be installed

 

John Stevens, Richard Smith and Brian George left the meeting.

 

3.        MINUTES

 

The Minutes of the meeting dated 6th November 2008 were approved by all present and duly signed as a true and correct record.

 

4.        PLANNING & PLANNING MATTERS

           Applications to be considered at this meeting:

 

  • 1175/08 WITHDRAWN – Demolition of existing guest house and replacement with new residential dwelling The Cove House, Torcross
  • 1968/08/F REVISED PLANS – Swallows, Torcross (No need for further comment unless these plan clarifications cause a problem).  No Objection
  • 2069/08/F Alterations to create two bedroom cottage from one bedroom cottage Boat House, Torcross - No objection but it was noted that there was concern with regard to the increase in light pollution in this sensitive area abbuting a Nature Reserve.

Cllr. Foss left the meeting and returned after application 2087/08 had been discussed.

  • 2087/08/F Amendments to approval 53/0598/07/F for alterations to existing building, variations to replacement dwelling and other works within the cartilage of Prospect House, Prospect House, Hallsands – No objection.
  • 2119/08/F Amendments to planning application 53/0836/08/F for alteration and extension to dwelling L’Argonaute, Holmleigh Road, Torcross – No objection but the concern with regard to light pollution was again raised noting the increase in glass that is a current trend.

           PLANNING PERMISSION REFUSED

  • 1150/07/F Part demolition and erection of new bedroom wings with ancillary accommodation Fairfield House, Chillington

 

5.        PROPOSED DROPPED CROSSING OUTSIDE STOKENHAM PRIMARY SCHOOL

 

Councillors were appraised of the County proposals for a new crossing and such adjacent parking along Kiln Lane adjacent to Stokenham Primary School.  Consideration was given to this scheme and the clerk advised that parents were now being encouraged to park in areas adjacent to the Church House Inn, Stokenham and then walk along with the school walking bus.

 

It was AGREED that the clerk should write to County advising that they had serious concerns which should be regarded as an OBJECTION with regard to this proposal as set out below

  • It was felt that those children guided by the walking bus were under supervision and thus this crossing was not necessary for those children.
  • The loss of parking at this point was felt to increase school delivery problems and the remaining legacy left by the dropped curb and bollards had a far greater legacy than school hours.
  • Those walking late at night, with no lighting, perhaps attending the parish hall or those visiting and walking down this very dark area unaware of these intrusions caused extreme concern with regard to Health & Safety.
  • Whilst safety of the children is felt to be paramount it was observed that highway education was first and foremost important and this ‘safe crossing area’ only increased the possibility of accidents (which have not occurred to date) by perhaps giving children the message that this area was ‘safe to cross’ regardless of the fact that it is close to the junction where vehicles turn off from the main A379.
  • As a primary school it was felt that most children arriving for school are supervised by parents and thus crossing took place from the point of their cars.
  • Concerns were discussed for residents and visitors walking this area in the dark and the short time of usage by school participants noted, the obstacles in the highway were considered a considerable hazard also.  Road users local and visiting are already thrown by the historic highway intrusion, not welcomed by parish council on its inception, at the juncture of Carehouse Cross with Kiln Lane (accessing from Kingsbridge).  This intrusion now creates a slalom for those approaching from Kingsbridge thrown around a corner from one side and then swerving back in again just by the opening of the school.  The proposed route is felt to be counter productive.

 

6.        LOCAL GOVERNMENT REVIEW

 

Councillors considered the data provided by District and wished the clerk to respond that this council noted concerns and had responded that they wished to keep the Status Quo. 

7.        QUALITY PARISH COUNCIL RE-ACCREDITATION

 

The Chair complimented council on achieving re-accreditation.  It was requested thanks be recorded for the Clerk for all the hard work in achieving this accreditation.  The Chair went on to urge councillors to test and use the Blog.  The content of the latest newsletter content was approved and it was AGREED that a short questionnaire be sent out with such newsletter requesting parishioners to put forward views and concerns with regard to the updating of the parish plan and ongoing projects.

 

8.        REPORTS

 

Matters around the parish requiring attention:

 

None received.

 

 

           KINGSBRIDGE & SALCOMBE ESTUARY

 

Cllr. Ray Warden advised that many representatives were present District Councillors, Ecologist's, Bird watchers, AONB (Robin Toogood), Harbour Master, Estuaries Officer (Nigel Mortimer), shell fishing in the estuary representatives, National Trust, Natural England, several representatives from various Parish Councils, and many others.

 

The meeting outlined the funding for the care of the five estuaries and important things that have been found and are being carried out and the need to include people in caring for and understanding this important feature.

 

           START CIRCLE OF FRIENDS AGM

 

Cllr. Warden advised that he had attended this AGM and gave brief details of the forthcoming fundraising intended.  The Chair Mike Mocatta gave a report and thanked Lesley (secretary) and Les (treasurer) Cowley for all their hard work together with the support given by all the drivers.  SCOF were proud of all their support to the Health Centre and their assistance in providing the new consulting room.  Les Cowley went on to thank Mike Mocatta for all his support and also the retiring members Warwick and Rita.  The new Chairman is Roger Ingall

 

           CHILLINGTON COMMUNITY ASSOCIATION

 

Cllr. Warden noted that the association had run a successful fireworks evening.

 

           BEESANDS VILLAGE GREEN

 

Cllr. Mrs Hutchings gave a report as attached.

 

           BEESANDS FLOODGATE

 

Cllr. Foss advised that an opening ceremony is to take place and that he along with the Chair and Clerk would be attending.

 

           CLERK’S REPORT

 

The clerk drew councillors attention to the following:

 

  • Email from Neil Oxten Highway advising that the fingerpost at Beeson Pool would be in place before 28th November (councillors advised that this had arrived today).  Consideration was then given to the previous request to County to change the sign on leaving Beesands from ‘Kingsbridge – Alternative route’ to ‘Kingsbridge’ as the businesses and some residents had felt that many were adverse to taking an alternative route an thus the one way system was being abused.  Councillors still supported their initial request for ‘Kingsbridge’ only sign.
  • Clerk had attended the SDCLAG meeting and the Management Team had been duly appointed.  Upward of 100 people attended and paperwork for application was provided.
  • Cllr. Mrs Nuttall-Smith and the Clerk had attended a meeting called by Alan Denbigh, Slapton Line Forum to bring together all ideas with regard to future interpretation of the area.  Some of those attending included Sue Beswick – Marketing, Doug Hulyer – English Nature, Heritage lottery etc., Andy Pratt Head of Slapton Field Centre, Chris Massey on behalf of Mark Brooking (Stokeley Farm Shop and surrounding land), Jim McPetrie Slapton Parish Council along with the Architect from GHK and another resident.  Much was discussed and both the Cllr. and clerk felt the meeting had been positive and helpful.  The architect was to engage the services of a charitable body to fund a feasibility study and therefrom a further meeting will be called.
  • Lady Frere of the Judiciary of England and Wales and confirmed her interest and willingness to attend the next Annual Parish Meeting to appraise those attending of the services provided by voluntary magistrates.
  • Code of Conduct for Local Authority Members and Employees.  Councillors were circulated with information to date and thus requested that the clerk place this matter on the agenda for 4th December for their responses to be recorded.
  • Shoreline Management Plan for South Devon & Dorset.  Meeting to take place at Harbour House, Kingsbridge 21st November – Cllr. Harwood to attend.
  • Letter from WRVS Head Office, Cardiff requesting support for the local Luncheon Club.  Councillors advised that they will only support requests for grants from the local branch directly into this parish.
  • Informal consultation: Footpath 10, Beesands.  Councillors were appraised of this diversion and were content that it could go to next full council for comment.
  • A request was received from John Halliday to attend the council meeting in January 2009 to discuss the issue with regard to the Torcross promenade.  This was agreed.

 

9.        DISTRICT COUNCILLOR’S REPORT

 

Having offered apologies no report was given.

 

10.      COUNTY COUNCILLOR’S REPORT

 

Cty Cllr. Brazil noted his concerns with regard to the implementation of Digital TV.  Discussion took place with regard to where people received reception from and Cllr. Brazil was concerned that residents do not get mixed messages as to when they go Digi.  The Chair advised that having received such presentation directly from David Farwig of Digi UK at the last meeting that councillors were content that they were aware of such changover.

 

The concern that was noted was the fact that vulnerable people were however being duped into thinking that they needed far more change and equipment that was necessary.  The Parish newsletter does however indicate that those with analogue tellys at present only need a viewbox at the cost of £25 (approx) and no other changes unless their DVD recorder needs replacing to be compatible with digi.

 

Cllr. Brazil then advised councillors that he had attended the SDCLAG meeting on Monday wherein the Clerk had been voted on as one of the Management Team.  Thus information was provided as to funding and possible application and he urged all councillors, as no Stokenham representation other than the clerk was made, to observe this document and consider putting projects forward.  Cllr Brazil did however note that it would be imprudent for the clerk to be applying or assisting in applications due to her position on the Management Team and thus it was beholdened on Stokenham Parish Councillors to utilize this funding stream and make such applications.

  • Cllr. Baverstock advised that whilst he would take part in discussions with regard to planning.  In view of his position as a District Councillor and the need for him to discuss such matters with the planning officers and thus keep an open mind on deciding whether such applications should go through under delegated decision or go to Planning Committee he would take part in discussions but not vote at parish level.  

He went on to express a personal interest in application 1939/08/RM being a neighbour of the property in question.

  • Cllr. Vale declared a personal and prejudicial interest in planning application 2029/08 being a close personal friend of the applicant.

The Minutes of the meeting dated 16th October 2008 were approved by all present and duly signed as a true and correct record.

 

4.        PLANNING & PLANNING MATTERS

           Applications to be considered at this meeting:

 

1939/08/RM Reserved Matters application for erection of dwelling (outline application 53/0151/07/O) Redlands, Kiln Lane, Stokenham – No objection.  However the height of the ridge of the roof was questioned but the Design & Access statement stated that this was a lower ridgeline and the plans confirmed this.

 

1940/08/LB Listed Building Consent for replacement timber windows Old Thatch, Widewell – No objection.

 

1968/08/F Replacement of roof to provide habitable accommodation at first floor level with associated works Swallows, Holmleigh Road, Torcross – No objection. Councillors however wish to raise concerns with regard to the amount of highly visible and thus the impact of glass and possible light pollution across this AONB, which will be highly visible from the tank car park.  A concern was expressed that planning officers were not taking into account light pollution in the area on recent applications in the area.

 

2000/08/F Demolition of existing garage and erection of extensions to front & side with associated works 4 Grenville Close, Stokenham – No objection.

 

Cllr. Vale left the meeting whilst this matter was considered.

           PLANNING OFFICER’S REPORT

It was AGREED to defer this matter until a future council meeting whilst additional information is gathered.

 

6.        QUALITY STATUS

 

It was acknowledged that a ‘blog’ has been added to the Council website to encourage the community to interact and post comments.  The following draft documents were also APPROVED by councillors along with the content of the portfolio for submission to the Devon adjudication panel:

  • Training and Development Policy
  • Community Engagement Strategy

 

7.        FREEDOM OF INFORMATION MODEL PUBLICATION SCHEME

 

Councillors AGREED to adopt the model publication scheme as approved by the Information Commissioner, to become operative on 1st January 2009, together with the Statement as to information provided and charges to be made by Stokenham Parish Council for providing such information.

 

8.        APPOINTMENT OF PARISH REPRESENTATIVES FOR DISTRICT STANDARDS COMMITTEE

 

It was AGREED to nominate Cllr Warden as a representative from this council to serve on the District Standards Committee.

 

9.        PLAY AREA MANAGEMENT

 

Cllr Baverstock concerned that one of the District’s criteria for upgrading play equipment was the amount of children using such and requested that the Clerk write and state that reduced numbers of children should not exclude equipment being improved.  His assertion was that children in rural areas should have more equipment provided as they have less access to leisure centre/swimming facilities in the towns.

 

It was AGREED that the Clerk to write accordingly and to enter into discussions with District with regard to improvement of play spaces in the parish and future transfer of ownership and maintenance of such to parish council.

 

10.      REPORTS

 

Matters around the parish requiring notification or action by the Clerk:

 

  • Lane up to Vicarage is in need of cleaning and maintenance, surface has fallen away at side, lorries are also taking the corner when accessing and it was noted that this is a planning condition.

 

 

           CLUSTER MEETING

 

It was noted that a very informative presentation was made by Alan Robinson and an associate with regard to the Local Development Framework.  During question time however the Chair felt there were those who thought the LDF was only about housing as that was all discussion centred upon, he noted that there is a lot more to the LDF.  Cllr. Baverstock highlighted that there had also been much discussion about the allocation of tenants to affordable housing and local concerns.

 

           SALTSTONE COMMITTEE

 

There had been an excellent turnout of representatives from parishes.  Cllr Foss advised that Phil Norrey had attended but interestingly had taken the Boundary Review discussion a step further as to how they saw a Unitary working.  Cllr Foss advised that he was reasonably encouraged by this discussion illustrating how community groups/boards could work.  Saltstone could be a vehicle group for such Board but the important issue with no answer as yet is planning in a Unitary model.  He did not get any impression that the parish council would get much more power.

 

           AREA OF OUTSTANDING NATURAL BEAUTY

 

The Annual forum took place at Yealmpton wherein presentations were given on ‘Is planning a blockage in the AONB and its progress’ followed by Questions and Answers.  This meeting highlighted the point that it is important to keep the visual aspect of the AONB whilst ensuring it is a livable, workable environment.

 

           CLERK’S REPORT

 

The clerk drew councillors attention to the following:

  • A suggestion of a possible Local Community Transport project to provide a service to rural communities that have lost their post office through joint funding with SDCLAG funding.  Cllr. Baverstock thought parish council should express an interest whilst the Chair would prefer to support the hopper bus.
  • SDCLAG open meeting 17th November 2008 6-8p.m. VI Form Lounge, Kingsbridge Community College.
  • The poor notification of the deferred resurfacing of the A379 from Carehouse Cross to Torcross and emails from Brian George and ensuing discussions with Cllr. Brazil.  Cllr. Brazil advised that Brian George is to attend the Stokenham Parish Council meeting on 20th November 2008.
  • Consultation paper on Codes of Conduct for Local Authority Members and Employees with a response date of 24th December 2008.
  • District notification of Residents’ Parking Permits at a cost of £10 to come into effect from 1st February 2009.
  • Slapton Annual Research Seminar Saturday 8th November 2008.
  • Copy correspondence from Devon County with regard to the usage of the Torcross promenade.
  • District Budget meeting 15th January 2009 wherein representatives from County, Police and Fire & Rescue Service will attend.
  • Also an update on the progress and matters concerning the Pilot project.

 

11.      DISTRICT COUNCILLOR’S REPORT

 

Cllr. Baverstock advised that he is attempting to set up a Beesands Village Green Committee meeting on the 18th November.  Some representatives however are resisting the attendance of two parish councillors even though he had explained that parish council now have one councilor who is resident in Beesands and therefore should be involved.  In February each year Endurance Life hold a race which gathers in Beesands and the residents on the Beesands Village Green committee do not want them parking on the village green, thus Cllr. Baverstock is seeking advice from District legal section.  He is hoping this will increase knowledge on the legal standing of the committee and green status.

 

Touching on County issues Cllr. Baverstock noted that the A379 Stokenham to Torcross had been crying out for years for the road to be re surfaced and initially this year notification was provided indicating that this was going to be done.  As a District Councillor he then advised people not to worry about potholes and then in the last few weeks unofficial notification had been received that this section is no longer a priority and not being carried out.  Thereafter there was a indication that it might be included before the end of the year.  Further a fingerpost is missing pointing to Beesands and it is revealed that this had not even been ordered.

 

Thus Cllr. Baverstock felt we were suffering as a parish with the current financial situation as it matures.  With the recent Fireworks Display residents in Chillington are fighting to get their hall upgraded and are reliant on planning s106 monies but in the financial climate it was not expected to go ahead and thus no monies will be forthcoming.  On another matter Cllr. Baverstock is requesting from District a report with regard to beach patrols last year to ascertain their views on how they felt with regard to beach patrols being centred on the monument car park instead of Torcross.  Also he was seeking comments on the change of buoys layout at Torcross.

 

12.      COUNTY COUNCILLOR’S REPORT

 

Cllr. Brazil agreed that situation with road is not good enough and he also had never received an official response yet.  He advised that Brian George is attending Parish Council next month during Open Forum.  His understanding was that more projects that were capable of being completed had been put in the programme on the assumption that there would be slippage but this did not occur and then they just cancelled this job.  Cllr. Brazil asserted that this was no way to run a budget and these were questions and comments for Brian George next meeting.

 

He went on to state that Stokenham Parish Council should now choose as to when they wish the road works carried out and not be hampered during the holiday season due to Highways lack of planning.

 

Cllr. Brazil advised that a grant for Stokenham hall for £7,000 had been approved. 

 

With regard to the play areas District have tried for ages to divest themselves of these but never quite ‘bitten the bullet’ and Cllr. Brazil asserted that a letter sent by parish should let District know that under no condition are they interested in taking on play areas and equipment unless they are put in perfect order firstly.  He advised that the money is around and parish council should make a ‘big wish list’.

 

With regard to the Pilot/Devolved services his comments for Chivelstone were that initially parish councillors were slightly aggrieve that their toilets were included and now their street sweeping without initial communication. 

 

His personal opinion of the feeling of the Saltstone meeting was that if asked he did not feel the majority would be in favour but if Phil Norrey offered the car parks to Kingsbridge Town Council they would have said yes.  That said he felt that the worst case scenario would be if the Secretary of State deferred her decision on the way forward and we were left with the present inertia.

 

Cllr. Brazil went on to advised that with regard to the Coleridge Bus he had managed to secure £45,000 from County from the sale of the airport towards a new bus.  Continuing with rural transport he noted that Chivelstone parish council are trying to install a secure website where local people can post the fact that they are going to Exeter or Plymouth etc in order that others can car share.  There are however security issues to consider when making such information available.
