The Chairman noted the hard work put in by the Clerk in her capacity as Salcombe Town Clerk and congratulated her and Salcombe for a successful Royal visit.

1. DECLARATIONS OF INTEREST

Councillors were invited to declare any personal or prejudicial interest, including the nature and extent of such interests they may have in any items to be considered at this meeting. They were also reminded to consider whether in the light of recent activities any items within their Register of Interests should be updated.

  • None received.

2. OPEN FORUM

Pat Nettleton advised that she had two things to bring to the attention of parish council. Firstly she had recently attended the launch of the Spiritualised bus which helps young people on a Friday evening and has been funded with assistance from others. They are hoping to bring this bus out to villages and get the young people involved and provide contacts should they be needed. At present Spiritualised offer a service in Kingsbridge to see youngsters home or assist them with any problems they may have at home that are stopping them going back.

Pat Nettleton then moved to a planning application adjacent to her property in Holmleigh Road and advised that she had agonised on whether to comment as they are a close community. She felt that the proposal was out of character with the original style eaves and small windows. Such development would overlook and by its design be overbearing as having lived there for 20 years they like to sit in their front garden and do not want to feel that someone is above them on a balcony observing. It was noticed that traffic uses this route coming past and they can be seen but this it was asserted is transient. An assertion is that the applicant is trying to make the property disabled friendly which it is felt is misleading in the design and access statement as they are talking about a Stannah lift but there is already flat access into the house whereas the new access has steps. In relation to planning issues from when this property was first developed Pat Nettleton had attended Follaton House to look at the original application but District could not find the old application!

Andrew Biggs of Marchand Petit attended on behalf of Taylor Wimpey in relation to the Helmers site to try and raise awareness that most of the Discount Market Value properties are still available. The site is going very well but there are very few enquiries for these which is disappointing. For the rented affordable housing and Discount Market Value properties ,which are 20% discounted on the open market value £168,995 both demand housing need and the buyers must qualify for the local criteria. After 3 months these Discount properties must go out to the wider parish area and so far only 7 people have even enquired about the 5 units. Dist Cllr Baverstock noted that he knew of one young couple in Chillington who now have approval to become resident in Helmers but the problem that faces a lot of younger couples is findin the 5% deposit (£8,000). He enquired whether TW could assist. The question was raised as to what the strict criteria was and most importantly they must qualify for housing need and in order to do this must go on the housing list firstly.

TW will contact the Kingsbridge Gazette with an article to highlight such an an item will be placed on the website and in the Parish Magazine.

Cllr Vale arrived at the meeting.

Chris Hyson simply had a question with regard to the s106 monies. The Clerk gave an explanation of all such monies with a development plot breakdown. Another councillor wished to know what the community's thoughts were of putting all such monies into the village hall or whether they wish play equipment too? This will be addressed at the Chillington Community Association open evening.

On the question of whether some of the Stokenham Parish section 106 monies would go outside the parish towards sport it was asked whether there were monies outside the parish to come in? It was advised that unless there was a specific sport or open space project in this parish not provided elsewhere then monies go to towns to provide combined sports facilities.

3. MINUTES

The Minutes of the:

(a) full council meeting dated 16th June 2011 were approved by all present and duly signed as a true and correct record – Approved.

(b) Planning Committee dated 4th July 2011 were approved by all present and duly signed as a true and correct record - Approved.

4. PLANNING & PLANNING MATTERS

The applications below were considered at this meeting and the following observations submitted to District:

  • 1618/11/F Householder application for provision of balcony at rear of property 4 Holmleigh Road, Torcross – Objection. This application was to remove part of the pitched roof porch and replace with a flat balcony extending on to the end of the building. The proposal was for a small balcony 4ft by 10ft with steps leading out on to a higher level approach. Once the balcony is installed it would be a stepped access and probably only have room for two seats which would it was felt affect the amenity of neighbouring properties. Such overlooking was felt an unacceptable loss of the neighbours amenity and the addition not felt acceptable for the design of this property.

  • 1637/11/F Householder application for erection of garden fence 14 Cotmore Way, Chillington – Objection. This proposed structure appears to close the property in and is not felt to be in keeping with the streetscene. It is believed there is a civil covenant that wishes to keep the estate open plan whereas this fence is to be 2 metres high and it was questioned whether this was also against policy.
  • 1665/11/F Permission to replace extant planning consent for 53/1197/08/F (for alterations and extension to dwelling) Pennistone, Fairfield Way, Chillington – No objection.

PLANNING CORRESPONDENCE

  • Email of objection in relation to 4 Holmleigh Road, Torcross together with a copy of another objection sent directly to District.

5. PUBLICATION OF DRAFT MINUTES

It was AGREED to continue with the present arrangement and reconsider in future should the need arise.

6. PLAY EQUIPMENT PROPOSALS

It was noted that to date only two proposals and costings for play equipment had been received and councillors were updated on such progress and DEFERRED consideration of these plans and a decision for Beesands pending having three quotes on the table.

Whilst on this subject it was suggested that in future Parish Council could look to provide outdoor adult equipment in Stokenham, maybe on the Village Green, to balance toddlers and young people at Beesands and toddlers up to teenagers at Chillington.

7. PLAY AREA REPORTS

It was noted that the District insurance reports with regard to wear and tear received by parish council had been taken back by Ross Kennerley as District own Beesands Village Green and maintain the equipment at Stokenham Playingfield. A Health and Safety issue with regard to Stokenham Play Area with regard to the perimeter hedge between such and the playgroup was raised by District and Cllrs Vale, Rogers and Dist Cllr. Baverstock offered to voluntary carry out these minor works.

8. COUNCIL WEBSITE

During March 2010 it was agreed by parish council to allow £1500 for a website. However in July 2010 it was noted that no response had been received from the chosen company and a working group was brought together again. Monies were never re appropriated in the 2011 precept pending further decisions.

Information collected by the newly formed working group together with estimates received to date were presented by Cllr Mrs Steer and discussed. She noted that the group met and carried out some research on what is currently on offer also looking at the parish council's own website. Suggestions made were that any future website must be geared to residents as well as visitors, and improvements could be made to the business side of the website as if it was moved to a company it would have to pay to facilitate such so would have to generate income to cover costs.

Various sites around the community were noted and the amount of control that was allowed or charged for. The Chairman advised that Peter Greening had offered to continue to run the current website and train a person to take over.

It was AGREED that the sub committee meet with Peter Greening to discuss further.

9. PARISH COUNCIL NEWSLETTER

It was AGREED to accept Cllr. Cowley's offer to undertake the drafting of such future editions of the quarterly newsletter for approval of such copy at full council before printing.

10. POLICE SPECIAL CONSTABLES

Questioned proposed from Devon and Cornwall Police. 'Special Constables are volunteers from the community who act in support of the Regular Police Officers and PCSOs within your community. Special Constables have the full powers of a regular Police Officer when they are on duty and are properly trained and equipped to carry out a variety of policing functions. Parish council are to consider how they would like to see them utilised to best effect within the community?'

Dist. Cllr. Baverstock noted that in his police career in Stokenham in the late 50s early 60s special constables were part of a team and authorised to do anything takes that a police officer could unlike PCSOs who have limited powers. When back in the late 80s the Special Constabulary dropped off in popularity with regular police and there were a limited number of Special Constables they were used for special events like the Dartmouth Regatta. The Police Force are now cutting police in Devon and Cornwall by about 700 and are realising that Special Constables who are all volunteers could be 're-born'. Somewhere like Kingsbridge would have volunteer people based in Kingsbridge and fully trained to then be in a position to act exactly as police officers, allowed to drive police vehicles and could be utilised quite quickly. Times like when Parish Emergency Plan is put into action could utilise their services.

It was RECOMMENDED that parish welcome return of Special Constables fully trained with full powers to supplement the local police force for any local events or emergencies.

11. REPORTS

SALCOMBE KINGSBRIDGE ESTUARY FORUM

Cllr. Ansell outlined all the people involved in this meeting. As half of this parish drains into the Estuary via Frogmore Creek the forum is important to this area. It was noted that the group are trying to reduce harmful nutrients that are going into the estuary and are promoting making this a phosphate free washing up liquid area.

There have been having interesting problems with sewerage from Salcombe going to Malborough. Apparently salt water it getting into the Salcombe sewerage and giving problems with the digestions bugs at the Malborough plant.

On the conservationist side Cllr Ansell found it strange that there was report from these groups what birds they had shot! Also it was noted that 'gangs' from Plymouth had been illegally netting with fixed nets to fish the estuary which is not allowed and whilst around had removed outboard motors from boats on their way!

STOKENHAM SCHOOL

The Clerk had invited Devon County CEO Phil Norrey to visit Stokenham school and see for himself the crowding problems. At present he is seeking to find a way to channel funds towards the school. Cty Cllr. Brazil had felt however that the CEO was guarded in his comments and did not promise anything. Dist Cllr. Baverstock noted that Christine Channon from County, was an influential decision maker who would be visiting the school in September 2011 and it would rest on her decision. As Stokenham School was at the forefront of the Vanguard of Federating schools this building extension would be a step forward for an important hub for the Federation.

It was noted that the Chairman and Clerk had then taken Phil Norrey around the parish to show him the area and highlight issues such as the state of the road due to lorries carrying equipment and supplies to development sites. Other matters of concern around the parish were also discussed with Phil Norrey.

Matters arising around the parish:

  • A councillors had been approached by someone from Beesands in relation to a house at the end of the village as it was asserted it now looked like a 1970s council house and the person had raised issues with planning. Dist Cllr. Baverstock noted that these issues were raised with planning but advised that the developers had used a loophole in planning law. The original planning permission was for wood windows and the developer then went for a material change that was granted for UPVc and as a minor amendment such did not come out for consultation. The rear of the lean to is supposed to be clad in lead but now has a brighter substitute and the enforcement officer has visited and will report back but this matter is ongoing.
  • The posts surrounding the village green have rotted and District have already been notified and agreed to carry out maintenance.
  • Camper vans and overnight camping at Beesands. This has been reported to District, as they are returning on a weekly basis. Dist Cllr. Baverstock had been assured by traffic enforcement that the officer is agreeable to carry out, out of hours enforcement.
  • Nigel Heath from The Cricket Inn had reported that his brown highway sign had been removed from the Beeson Pool signpost. It was not felt that Highways would have removed a designated brown sign.
  • A concern was raised that it was noted that someone was digging a hole in the duckery platform and installing a drain. Cllr Ireland noted that these works were being paid for from the Torcross fund. Previously they had cleared, laid turf and installed a bench. However the ducks completely killed the grass and they were trying to come up with way to make this area look good again so the drain was lowered to go underground and run into the ley and then such area was to be levelled and flint chippings put down for a permeable layer. All such works have been from the Torcross Fund and a generous donation from the Slapton Line Forum.
  • There continue to be problems with parking on the slipway at Torcross with three cars and a trailer. This will be brought to the attention of the parking wardens. Also the bathing buoys have been put out.

CLERK’S REPORT

  • Further email received from a councillor at South Pool with regard to the large vehicles using the lanes - Noted.
  • Highways have reported back following the walk through the parish to advise on matters of concern raised – read out.
  • Various reports and correspondence received highlighting what District and others are putting in place for the Diamond Jubilee.
  • Attended District to clarify the progress on the transfer of land at Helmers and Torcross Viewpoint. Legal have advised that they may have to advertise for six weeks their intention to dispose of land to another authority. District will also require an approach directly from the Chillington Community Association with regard to their wish to take on the monies and implement the build – Chris Hyson to so write.
  • Discussion at the District meeting also covered the Beesands Play Area monies allocated from District and if Stokenham Parish Council obtain a further quote to ensure three quotes they can they choose a supplier and hand to District to commence.
  • District have put out a consultation paper, with responses required by 30th September 2011, on the future of standards in local government with the proposal to abolish the Local Standards Framework through the Localism Bill. NALC however have advised that the committee stage of the Localism Bill produced views that counter the Government’s position in relation to the future of the standards and this is to be challenged at the third reading of the bill following the report stage by the Lords in September 2011.

12. DISTRICT COUNCILLOR’S REPORT

Dist Cllr. Baverstock noted that at the Helmers Field development there are windows in place that local people feel should not be there, these are facing Tanpits way and some windowsills have been built into walls. All these points are being monitored by District. He then noted that the Parish Council Chairman and he attended a Cluster meeting in Ivybridge wherein District were expressed to parish councils that Localism and the Big Society are on their way. Therefore they are trying to start to get parishes to think for themselves what they want to provide in place of District. Dist. Cllr. Baverstock noted he will watch how this discussion progresses. Perhaps he suggested some felt the meeting was a waste of space but in the end of he felt that parish councils needed to consider how they are going to pay for such provision of services in the future. District are saying they will pass money to parish council equivalent to what it costs them current to do these works.

He then noted that he and Cty Cllr Brazil had been at a District council meeting when it was eventually agreed that District supports Cornwall Council attempts to request legislation be changed to charge 100% council tax on second homes.

13. COUNTY COUNCILLOR’S REPORT

Cty Cllr. Brazil noted that he had passed copy letters to the clerk advising that they are trying to complete the reinstatement of a section of the South West Coastal Path and the worst section is in Strete. They have permission from a couple of landowners but a few are holding out. This work had been stopped due to legislation and they were now trying to get them to start again and therefore he urged Stokenham Parish Council to also write to Natural England. The Clerk was asked to write accordingly.

16. NEXT MEETING

Full council recess in August and therefore the next full parish council meeting will be held on Thursday 16th September 2010 at 7.30p.m. in Stokenham Parish Hall. The next planning committee meeting will take place on the first Monday in August, if plans received make it necessary to call such.
