1.         DECLARATIONS OF INTEREST

 

Councillors were reminded of their responsibility to continually update their Notice of Registerable Interests and invited to state whether they had a personal or prejudicial interest in any matter to be discussed during this meeting.

 

  • Cllr. Baverstock advised that whilst he would take part in discussions with regard to planning.  In view of his position as a District Councillor and the need for him to discuss such matters with the planning officers and thus keep an open mind on deciding whether such applications should go through under delegated decision or go to Planning Committee he would take part in discussions but not vote at parish level.
  • Cllr. Mrs Nuttall-Smith declared and personal and prejudicial interest in Tree Preservation Order 595 due to being the owner of such trees.
  • Cllrs Vale and Harwood declared personal and prejudicial interests in item 6 with regard to trees at Gratton Drive being a owner of some trees whilst Cllr. Baverstock expressed only a personal interest in this matter having already commented elsewhere on such as a District Councillor.

 

2.         OPEN FORUM

 

Two members of the public were in attendance Mr Heavisides and Mr Wakeling along with Pc Mutton and PCSO O’Dwyer.  Pc Mutton noted that the instigation of two monthly meetings for this council will assistance him making a monthly attendance.  He went on to advise that he will attend the Stokenham fete to be available to members of the parish.  During the last 2 months there have been 7 crimes reported compared to 10 at the same time last year.  Cllr. Baverstock highlighted concerns with young people driving at high speed and such danger to young children playing.  Pc Mutton noted there had been reports of youngsters hanging around in cars at Start Point and he would look in to both these matters. 

 

PCSO O’Dwyer advised that there had been an expression of interest in relation to carrying out a pack survey and wished to liaise with the local community on how and when to hold such.  It is expected to target locals and visitors to the area through a beach surgery.  Representatives would congregate at Torcross with a gazebo and necessary information about police and other local services and listen to what the local community think they should do.  Pc Mutton acknowledged that the police have been liaising with the school on speeding offences and also teaching children about road safety.  It is hoped that such consultation could be undertaken as cross partnership working with parish council. Cllr. Baverstock asked whether with less marker buoys in place at Torcross the police see any role in assisting with such conduct on the beach.  Discussion took place with other councillors also and it was noted that residents wish to feel supported if they report boat speeding or any other incident and this was acknowledged and agreed by the police.  Cllr. Mrs Nuttall-Smith also suggested that the police visit the WRVS Luncheon Club to talk to, receive information and advise older people.

 

Eric Heavisides noted that the recent Gazette had highlighted measures for free parking in Ivybridge.  He wished to know what was being put in place for Kingsbridge people?  Cllr. Baverstock responded that he was aware of these scheme and the fact that Ivybridge town is ‘dying on its feet’ with people not shopping there, shops shutting down and a subsequent District review took this drastic measure to encourage people back into town.  It was noted that when such argument was put forward for Torcross and historic parking in this area District advised this would be giving this area preferential treatment.  Cllr. Baverstock agreed that this parish should write expressing their thoughts and concerns.

 

Having commenced the meeting and approved the Minutes the meeting was stood down to allow Gill Hart to speak after a mix up with the venue of the council meeting.  She advised that she was one of the owners of The Close, Stokenham and acknowledged that currently it looked like a demolition site with drive being progressed.  She provided a written potted history of their property and had drawn an example of what it is intended to eventually look like should the proposed extension be allowed.  Discussion took place with regard to the landscaping and conditions that could be attached to any decision notice before Mrs Hart left the meeting. 

 

3.         MINUTES

 

The Minutes of the meeting dated 19th June 2008 were approved by all present and duly signed by the Chairman as a true and correct record.  

 

4.         PLANNING & PLANNING MATTERS

            Applications to be considered at this meeting:

 

0826/08/F Erection of dwelling 12 Cotmore Way, Chillington - WITHDRAWN

 

1194/08/F Extension and alterations to dwelling The Close, Stokenham – Objection.  This proposal by virtue of its shape and use of glass was felt to be an inappropriate design in such Conservation Area using unsympathetic materials which include too much glass on a south facing building.  The flat roof, glass panels and balcony were felt to have a huge impact on a highly visible and sensitive area of the village imposing an undesirable effect.  Whilst landscaping is proposed it was felt it would not soften the development quickly enough.  Any future extension it was felt should be incorporated within and blend with the existing building.    

 

Cllr. Harwood arrived.

Public Footpath 14 Stokenham – Approval to divert path near Coleridge Farm, Chillington – Noted.

 

Cllrs. Harwood and Vale left the meeting whilst the following matter was discussed and returned thereafter.

 

6.         OBJECTION OR REPRESENTATION RELATING TO TREE PRESERVATION ORDER

 

Councillors ratified the response put forward to the Tree and Hedge Appeal Group with regard to No. 23 TPO 762 Order 2006 Site: Gratton Drive, Chillington

 

Cllr. Baverstock advised that he has since been contacted by residents from Gratton Drive with regard to the size and damage done by some of these trees.  One has pushed the pavement up by four inches and is going to cause additional problems in the future along with branches hanging into the road.  One tree is also dwarfing a property whilst another is near to the kerb and making adjacent walls go green.

 

The Clerk was requested to write further and request the Hedge & Tree Appeal Committee to respond to all points raised by parish council before they confirm the Order.  The trip hazards and possible visibility difficulties should also be raised at that time. 

 

6.         REPORTS

 

Matters around the parish requiring notification or action by the Clerk:

 

Complaints of overgrown hedge in road that leads to Chillington Sports field as aged and disabled people find they have to walk further out into the lane.

 

It was noted that County have been carrying out pothole repairs in Kellaton.

 

Oddicombe Corner – concern was raised that there will be a bad accident at this point soon as double decker buses and lorries have frequently met there.  The clerk was requested to write to County requesting their comments on a road widening scheme.

 

It was noted that the Caravan Club have agreed to keep clear the permissive path from the Caravan Club to Farm Shop entrance and Martin Nuttall-Smith will clear from the church to the Caravan Club.

 

            SALTSTONE MEETING

 

Cllr. Warden noted that he had already received the Minutes of the last meeting and was disappointed to lose such an excellent secretary to the team.

 

            CLERK’S REPORT

 

Councillors were made aware of the comments from the District Council Conservation Area Team with regard to historic BT tel. boxes and possible listing.  It is for councillors to return to parish council if they note a telephone box they wish to retain under such listing.

 

The Clerk appraised councillors of the duties highlighted that parish council could take charge of from District and County and brought up to date on the possible costings allowed by District and County.  A report is to go forward to District Executive on the 10th July and when final details are known then a report will be put to parish to consider and if applicable approve.  It was noted that other district councillors are now against this proposed pilot feeling that more money should be spent on services in their areas rather than a pilot solely in Stokenham.  District Cllr. Baverstock is to challenge these assertions mindful of the benefits of this pilot and future structure of local government. 

 

It was noted that Ragwort has been identified by the Field Centre on the permissive path down at Torcross by the Ley.  If cut Ragwort spreads and the Field Centre are going to pull it by hand.  Thus contact should be made with the Field Centre before any cutting takes place.

 

County have now agreed to clear the section of their land at the junction of Coleridge Lane and the A379 returning it to its original state.

 

Developers have approached District offering a piece of amenity land at the Grist Mill site.  Councillors discussed various options but agreed that such land should be incorporated in existing property owners land with strict planning conditions to ensure its use remains open space.  The Clerk is to liaise with landowners and District officers.

 

Resident Mike Simmons reported weeds and brambles at the BT site and noted that they have been carrying out works on their own property but this was not their responsibility.  Also Mrs Simmons had kindly cleaned the road sign as it was becoming unclear and this was appreciated by councillors.

 

An acknowledgement has been received from Tim Bowden of the Boundary Committee with regard to Stokenham Parish Council’s letter of concerns with regard to the Unitary bids.

 

Letter from District advising of public meetings scheduled following the Boundary Committee’s publication of their consultation.  Councillors were made aware of such dates.

 

Letter received from Local Works advising of the implementation of the Sustainable Communities Act and inviting councils to opt in to the process when invited in October 2008.

7.         DISTRICT COUNCILLOR’S REPORT

 

District Cllr. Baverstock noted that the Unitary concept(s) are to be announced on 7th July 2008 by email to all Chief Executives to arrive at 7a.m.  There will then be some time for Chief Executives to discuss the effect it will have on communities and for the consultation to take place.

 

Cllr. Warden noted an article in the Parish Magazine written by Dist. Cllr. Baverstock with regard to his evening in Torquay and noted that it was an example of the amount of work Cllr. Baverstock is doing on behalf of everyone, young people in particular.

 

The Chair noted that Cllr. Baverstock is just about to distribute the summer edition of his newsletter and would be including parish councils as well.  Thanks went to him for delivery.

4.         CO-OPTION TO FILL COUNCILLOR VACANCY

 

Following a presentation by Anita Hutchings, Colin Wakeling and Eric Heavisides, Cllr. Foss commented that he wished the parish council had three places to give all such enthusiastic candidates a place. 

 

It was AGREED that Anita Hutchings be co-opted as a councillor.

 

5.         PLANNING & PLANNING MATTERS

            Applications to be considered at this meeting:

 

1235/08/F Removal of conditions 4 & 5 of planning approval 53/0623/08/F Torcross Apartment Hotel, Torcross – No objection.

 

Cllr. Baverstock enquired whether the applicant had approached the parish council with regard to consulting the community.  Cllr. Ireland noted that there was still unrest within residents with regard the proposed loss of the bar.  The Clerk advised that she had spoken to the applicants and advised that there needed to be more than just he councillors present for them to have a true reflection of the community feelings.  No further approach has been received.

 

1299/08/F Extension and alterations to bungalow 10 Cotmore Close, Chillington – No objection.

 

1302/08/F Alterations to dwelling Church View Cottage, Kiln Lane, Stokenham – No objection.

 

            PLANNING PERMISSION GRANTED

0446/08/F Retrospective applicaton for resubmission of application 53/0452/07/F for extended decking and boundary treatment 1 Shindle Park, Chillington

 

0962/08/F Conversion of loft and associated internal works Sealarks, Kiln Lane, Stokenham.

Councillors were concerned with this refusal and were not in agreement with the statements given for such.  The Clerk was requested to write to Development Control requesting an explanation as to why the felt this property was overlooking and setting a precedent in order that councillors can use this guide for future reference.

 

            TREE PRESERVATION ORDER: GRANT OF CONDITIONAL CONSENT

TPO 552 (No. 4) Register No. 2722 Site Fairfield Nursing Home, Chillington Consent to : Reduce Ash by maximum 30%.  Enquiry by Nick – is reduction in height or volume.  Cllr. Vale Volume.

 

            PLANNING CORRESPONDENCE

 

Officers report 1149/07/CA and 1150/07/F Kaippans Care Homes Ltd. Conservation Area Consent for demolition of single and two storey structures and part demolition and erection of new bedroom wings with ancillary accommodation – Officers Recommendation : Conditional Approval.  Cllr. Baverstock advised that this report and application were due to go to the last committee but the matter was withdrawn at the last minute.

 

6.         DEVOLVED SERVICES PILOT PROJECT

 

The Chair gave an outline and update of the proposed pilot details so far (As attached).

 

It was AGREED to set up a Working Party comprising of Cllr. Mrs Nuttall-Smith, Cllr. Baverstock, Cllr. Greening, Cllr. Warden, Cllr. Arundell and Cllr Ireland to oversee the formulation, running and liaison for this pilot project with District and County Council.

 

7.         REPORTS

 

Matters around the parish requiring notification or action by the Clerk:

 

  • At the turning off the main Start Road/Muckwell Cross situated right in corner at the end of the white line is a dangerous deep hole.  Clerk to advise County.
  • Water is issuing through the tarmac on to the A379 by Holbrook Terrace.  Clerk to liaise with District and landowner.
  • There have been complaints with regard to the removal of the bollard at the entrance to the footpath opposite Holbrook – Clerk is to contact highways and ask them to repaint the lines on the highway by the opening.
  • Cllr. Baverstock has received a number of requests from elderly people in Chillington for a seat at the Post Office bus stop towards Dartmouth.  The Clerk advised that she had enquired of County with the earlier request for bus shelter and to date had received no response.  Cllr. Baverstock noted that residents are content to contribute towards a seat and thus the Clerk is to seek approval for such siting from County. 

 

            DEVON ASSOCIATION OF PLAYING FIELDS

 

Cllr. Warden advised he had attended the AGM at Ipplepen.  The formal part of the meeting and elections took place followed by presentations by Dave Scott, Planning Conservation Manager – Mid Devon District Council and Jane Henbrow Regional Development Officer for Play England and South West.  It was noted that play has so much legislation involved nowadays that it makes it difficult to get people to come forward and work with young people.  The whole day was very interesting and Cllr. Warden picked up many leaflets that he will pass on to the Chillington Community Association.

 

            AREA OF OUTSTANDING NATURAL BEAUTY

 

Cllr. Foss spent 3 days in Shropshire at the AONB AGM wherein 180 delegates took part.  The days were heavily filled with presentations one by Jonathan Shaw and Cllr. Foss noted that he was the only farmer in attendance.  On the second day they broke into groups and he chose to walk the Malvern Hills.  This gave him a chance to speak with many officers from Defra, Natural England, AONB reps and many others.  The Malvern Hills is an AONB in its own right and Cllr. Foss noted that the councils around there are mostly Unitary and the AONBs receive a lot of their funding from parish councils working out at about £25 per household.  The Wednesday evening after dinner speech was by Dr. Mark Horton.  Andrew Wood the Head of Natural England gave a presentation advising of AONBs, SSSIs, National Parks etc and advising that they want to roll out preservation policy over all the countryside. 

 

With regard to the undergrounding of power lines it was noted that Western Power are the only distribution unit/area in the whole of the country that has not voluntarily taken up EU money to assist towards undergrounding.  Cllr. Foss felt that parish council should push Western Power on this matter again.

 

            CLERK’S REPORT

 

The Clerk advised that a Maitland Walker solicitors had written on behalf of an independent company to advised that this company wish to re use BT telephone boxes.  The Clerk has advised of the call boxes due to be removed and expressed an interest in their project.

 

Cllr. Julian Brazil arrived

 

Digital TV Switchover - David Farwig has offered to come and speak to parish council about the changeover and can attend a meeting during the next few months.  The clerk is to arrange 4th August or some time in October.

 

The South Devon Coastal LAG bid group have now attended the RDA assessment and were well received and given enough time to put forward their case.  They have been asked to reduce their bid but are staying with their submission as it is one of the lowest and only £50,000 above the lower limit.  The final decision on bids will be 1st August.

 

Grass cutting – Torcross from the farm shop to the duckery has now been cut although no one is sure whether District contractors carried this out or the County tractor.  This will be clarified before the pilot project moves forward.  It was however noted that the area around the bus stop at Torcross needs cutting.

 

The new criteria for Quality Parish Status has been launched and Stokenham must now re accredit by 31st December 2008.    There is to be a QPS training day at £10 each delegate on 10th September 2008.  It was suggested that the Clerk and Chair attend.

 

Local Works – The clerk advised she had read the Sustainable Communities Act leaflet sent by Local Works and it does not appear to distinguish between parish/town councils and district/county.  From information therein it states that the Sec. of State is to invite councils in Sept/October 2008 to put suggestions forward on what would help councils to promote the sustainability of local communities.  At this point with the Unitary bid in it was thought prudent for this parish council to await more information in Sept/October before taking any further action.

 

BT Telegraph Pole – 1 Lea Cliff Cottages, Torcross:  The owner has requested and will pay for the moving of the pole from the middle of their hard standing to the side (end of wall).  The pole will then be placed on the highway tight against the properties front wall and will thus stick out about 18-20inches.  Parish council felt that the cables could be underground and failing this suggested the pole should be recessed into the property garden wall.  This matter will be passed back to highways as parish council are concerned with the height of the pole, being 3 metres higher than existing and the intrusion into the highway just before a blind corner.

 

8.         DISTRICT COUNCILLOR’S REPORT

 

The Boundary Commission consultation is continuing and Cllr. Baverstock gets the impression that District feel that the Boundary Committee has failed in not recognising the superb concept put forward by District.  District feel a Unitary County is going to be a retrograde step for this area as they have one of the lowest council tax rates in the County and it is the fear of District that council tax will increase considerably. 

 

The Chair thanked Cllr. Baverstock for his newsletter and for distributing the parish council newsletter at the same time.

 

With regard to the Coleridge Association and the Saltstone Group Cllr. Baverstock noted that Coleridge Association representatives had attended District Executive Committee and put forward a number of questions.  He went on to note that at some stage parish council must give some thought to what grouping of councils this council would want to align with for Unitary grouping.  He therefore questioned whether this council believes the Coleridge Association might put a claim in for this sort of grouping?

 

9.         COUNTY COUNCILLOR’S REPORT

 

Cllr. Brazil noted that the Boundary Commission favours the county bid.  He went on to advise that it is very important for parish councils, whether they like the bid or not, to have some input into how they see services run and power and decision making handled with regard to money and community interaction.  To consider is a complete Devon Unitary, a Devon Unitary minus Exeter and Exmouth or none of the above.  Therefore he urged councillors to take a view but having done this they must put forward a response setting out how parish council think such community boards etc should work. 

 

Cllr. Brazil noted that he was delighted that the devolved services pilot is going ahead and is fully behind it.  He offered his assistance should parish council believe that County are not engaged or have concerns that need addressing.

 

The Admiralty buoys are in place at Torcross but the Chair was concerned that they were too far off the coast.

Having closed the meeting District Cllr. Cane noted that he was thankful he had not been a candidate tonight as all applicants were outstanding.  He acknowledged that he could see why this was an excellent council from how well it was run tonight.  With exciting times forthcoming from taking on devolved services he noted that all parishes and towns will watch for mistakes but that this was a good learning curve. 

 

Cllr. Cane finished by congratulating Cllrs. Baverstock and Brazil as excellent District and County representatives.
